Deed of Levin Cooper & Samuel Cooper
Somerset Co., Maryland & Shelby Co. Kentucky
August 21, 1798 & March 26, 1803


To all it Whom it may concern be it known That I Leaving Cooper of Shelby County in the State of Kentucky formerly of the County of Somerset in the State of Maryland have made dained constituted and appointed and by these ? do make ordain constitue and appoint Samuel Cooper my true and lawful attorney for me and in my name to demand receive sue for receive take possession of and sell any land I have any claim to either by descent or otherwise in the State of Maryland and Particularly a tract of of land which I claim by descent in Somerset County in the state of Maryland on the head waters of Barren Creek and to do such act or acts to the premises as he may judge most benefice for my interest and other attornies or attorney under him to appoint with such powers as he shall think proper to delegate hereby ratifying and confirming whatever my said attorney or those under him may do relative to the premises . At about held for Shelby County August 21st 1798. The within Letter of Attorney was knowledged by the Levin Cooper to be act and Deed for the purposes therein mentioned and ordered to be Recorded & Certifyed (seal) In testimoney whereof I have hereunto set my hand and offisced the seal of the said County this 22nd day of August 1798 in the 7th year of the Commonwealth.

April the thirteenth day Anno Dom Eighteen Hundred and three, then was Delivered unto to me the Subscriber the foregoing Power of Attorney in order to be Enrolled amoong the Records of Somerset County which said Power of Attorney together with the certificate thereof thereon Endorses are accordingly recorded among the same Records in Liber O, Folio 252

This Indenture made this twenty six day of March anno Domini Eighteen hundred & three Between Samuel Cooper of Shelbey County & State of Caintuckey of the one part and Jonathan Waller of Sussex County & state of Delaware of the other part Witnesseth that the said Samuel Cooper for and in Consideration of the sum of fifty pounds ? to him in hand paid by the said Jonathan Waller the recept wherof the said Samuel Cooper hereby doth acknowledge he said Samuel Cooper hath granted bargained and sold alien confirmed and coveayed and by these presents doth grant bargain and sell alien confirm and conveay unto the said Jonathan Waller his heirs and assigns forever all his right Tittle clame and Intrest of a Tract of Land called Bedford formerly the property of Samuel Cooper dec'd and lying and being on the north side of a branch called barron creek which said land by areship fell to Levin Cooper of Shelbey County & State of Caintuckey and by his the said Levin Coopers power of attorney unto his son Samuel Cooper did by arbaliation recover from a certen John Grumbles his clame unto the afsaid Tract or parsell of land called Bedford which said land with all appertainencies whatsoever to the same Belonging or aney wise appertaining and also the reverson and reversions remanders and remainders of the premisses and of every part thereof and all the estate right tittle Intrest clame and Demand whatsoever in Law or equitey of him the said Samuel Cooper of in and to the said part of Bedford as aforesaid described and every part thereof To Have and to Hold the said parsell of land and all and singular the primesses and every part and parsel therof with the appertaininces unto the said Jonathan Waller his heirs and assigns forever and the said Samuel Cooper for himself his heirs exec. and adminstrators doth covenant and agree with the said Jonathan Waller his heirs and assigns forever that he the said Samuel Cooper his heirs exeutors and adminstrators and all and every other person and persons lawfully claiming or to clame any Estate right Title or Intrest of in to or of the said hereby bargained primesses or any part thereof by from or under him or his heirs shall and will at all Times hereafter upon the request and at the proper costs and charges in Law of the said Jonathan Waller his heirs or assigns make do and exeute any futher deed for the ? ? of the said land with the appertainences unto the said Jonathan Waller his heirs and assigns forever. In witness wherof the said Samuel Cooper to these presents his hand hath set and seal affisced the day and year first above written<

Maryland Somerset County ? Be it remembered that on the day and year first within written personally appeared before us two of the Justices of the peace for Somerset County the within named Samuel Cooper of Shelbey County & state of Caintuckey and did acknowledge the within Deed and the lands & premisses within mentioned to be the estate right title and Intrest of the within Jonathan Waller his heirs and assigns forever and for no other Intent use or purpose whatsoever.
