Deed of Bradley/Bennett

This Deed made this Second day of September in the year of Our Lord Eighteen Hundred and fifty seven by Jeremiah Bradley and Mary A. D. Bradley his wife, Benjamin P. Gravener and Eleanor Gravener his wife and Levin Graham and Sally E. Graham his wife, all of Somerset County in the State of Maryland, witnesseth. Where as Elisha Bennett late of said County deceased by his last will and testament bearing date on the twelfth day of September, in the year Eighteen Hundred and fifty, and now of record in the office of the Register of Wills of Somerset County, devised all his real estate to his six sons Levin Bennett, Thomas B. Bennett, James Bennett, Gillis Bennett, Elisha P. Bennett and William Bennett equally and jointly, and departed this in the month of March Eighteen Hundred and fifty seven leaving the said will unrevoked, and after the execution of said will and before the death of the said testator the said Gillis Bennett departed this life, intestate, unmarried and without issue, leaving his brothers above named and his sisters Mary A. D. Bradley wife of Jeremiah Bradley, Eleanor Gravener wife of Benjamin P. Gravener, Sally E. Graham wife of Levin Graham, and a nephew Henry W. Taylor son of his sister Nancy Taylor, Elisa A. Bennett and Hester P. Bennett, his next of kin and heirs as law on whom his interest in said real estate devolved; and the said Mary A. D. Bradley, Eleanor Gravener and Sally E. Graham have agreed to sell and convey to their said brothers Levin, Thomas, James, Elisha and William all their interest in the real estate which was of said Elisha Bennett in his lifetime, and to which they are entitled as representatives of said Gillis Bennett. Now therefore in consideration of the premises and the sum of nine hundred dollars current money, the said, Jeremiah Bradley and Mary A. D. Bradley his wife, Benjamin P. Gravener and Eleanor Gravener his wife, and Levin Graham and Sally E. Graham his wife do grant unto Levin Bennett, Thomas B. Bennett and William Bennett of Somerset County all the right, title, interest and estate of them the said Mary A. D. Bradley, Eleanor Gravener and Sally E. Graham of, in and to and out of the real estate which was of their father Elisha Bennett deceased at the time of his death-consisting of the lands whereon he resided at the time of his death, called Algate, Lebanon, Russum's Hard Bargain and Bennett's Beginning, or by whatsoever other names the same may be called or known, containing two hundred and twenty seven and one half acres more of less also, all the lands and mills known as the Barren Creek Mills which the said Elisha Bennet purchased from William Williams and wife, and John B. Taylor and wife, described in the deeds of said William Williams and wife dated sixteenth day of November Eighteen Hundred and forty seven; and of John B. Taylor and wife dated nineteenth day of March Eighteen Hundred and fifty two, to said Elisha Bennett, as by reference to said deeds, duly executed and recorded in the office of the Clerk of the Circuit Court for Somerset County will fully appear-also, a lot of ground containing two and five eighth acres, on the North side of the Barren Creek grist mill and pond, which the said Elisha Bennett purchased from Levin Cooper, and all other lands or real estate (is any) of which the said Elisha Bennett may have been seized or possessed at the time of his death, - in fee simple.

And the said Jeremiah Bradley and Mary his wife, Benjamin P. Gravener and Eleanor his wife, and Levin Graham and Sally his wife, convenant that they will warrant specially the property hereby conveyed; and that they will execute such further assurances as may be requisite.
